Pope Francis addressed a message to participants in the presentation in Tenerife, Spain, of the book in Spanish “Past, Present and Future of Transitional Justice: The Latin American Experience in Building World Peace.” The Pope addressed his message to Enrique Gil Botero, Secretary General of the Conference of Ministers of Justice of Ibero-American Countries, who invited the Pope to say a few words on the subject, and to José Ángel Martínez Sánchez, President of the General Council of the Spanish Notariat.

Recalling that transitional justice refers to judicial and political measures adopted after a period of war or widespread human rights violations in order to promote reconciliation and democracy, the Pope observed that it involves many levels of action, including the application of justice, assistance to those affected and government reforms.

Learning from the past

Taking as an example the historical circumstances of America and Europe in the 16th century and addressing the effects of colonialism, the Pope said that it is first essential to learn the lessons of the past by examining the often painful experiences that require coherent and meaningful responses to current challenges, as well as mechanisms to consolidate progress on the path of peace, freedom and justice.

He added that addressing and clearly considering the pain of the past is part of the process of healing and hope for the present and the future, a responsibility that must be assumed by all. Past circumstances may be a revolution, a change of regime, an invasion, but all require a willingness to confront this history and resolve it so that it becomes part of the path to a new harmony and peace.

The Pope then stressed the need to provide immediate responses through the rule of law, with courageous, innovative and concrete solutions that touch the heart of the truth about the dignity of the human person. This may involve institutional reforms and concrete assistance to those affected.

Finally, the Pope acknowledged the challenge of the effective and concrete application of these provisions, because it is necessary to guarantee the means so that a treaty, a signature, a law can be effectively implemented. He said that seriousness, common sense and patience can make this effort possible.

The Pope encouraged everyone to be courageous and determined, trusting in God, taking responsibility for applying justice, opening paths of understanding and fraternity and building harmonious societies.
